January 19, 2012
- Butler County has revised the Butler County Subdivision Regulations
which are administered, in part, by the Butler County Storm Water
District. These changes bring Butler County's erosion and sediment
control (ESC) standards up-to-date with federal and state requirements
for the National Pollution Discharge Elimination System (NPDES)
Construction General Permit and protect our natural resources
during all phases of development. These regulations include a
fee schedule for the plan review(s) and inspections of subdivision
and individual lot developments and enforcement procedures for
non-compliant sites. The following sections describe the process
and requirements for the Butler County Earth Moving Permit and
the Butler County Lot ESC Permit.
The Butler County
Earth Moving Permit (EMP) is -
- Required
for new development projects that are governed by the Butler
County Subdivision Regulations.
- Required
prior to any earth disturbing activity including, clearing, grubbing,
and cut/fill activities.
EMP Process
- Submit a
completed EMP application, appropriate fees (see below), and
ESC or Stormwater Pollution Prevention Plan (SWPPP) to the Butler
County Planning Department.
- Within two
weeks Storm Water District staff will review the submitted items
for completeness. If plan revisions are required, a letter will
be sent to all applicable parties describing the nature of the
required revisions.
- Once all
items are approved, the EMP applicant must contact the Butler
County Storm Water District to schedule a pre-construction meeting.
An EMP will not be issued without a pre-construction meeting.
- Upon completion
of the pre-construction meeting, the EMP will be issued to all
parties listed on the application.
- Routine
inspections will be performed by Butler County Storm Water District
staff throughout project life to ensure compliance with the 'Soil
Erosion and Sediment Control' standards.
- After each
inspection a status report will be prepared and distributed to
the appropriate parties.
- If it is
found that operations are being conducted in violation of the
approved ESC or SWPPP, then enforcement action as authorized
by O.R.C. 307.79 will be initiated.
- EMP will
be released after all earth disturbing activities are complete,
and the site is stabilized with permanent vegetation.
EMP Fee Schedule*
Residential
Subdivision - $75/disturbed acre (Min=$1,000 and Max=$5,000)
Commercial
Subdivision - $100/disturbed acre (Min=$2,000 and Max=$10,000)

The Butler County
Lot ESC Permit is -
- Required
for new construction on a single lot where earth disturbing activities
equal or exceed one acre.
- Required
for new construction on a single lot that is part of a greater
plan of development (e.g. new home building site within a subdivision).
- Required
prior to any earth disturbing activity including, clearing, grubbing,
and cut/fill activities.
Lot ESC Permit Process
- Submit a
completed Butler County Lot ESC Permit application, appropriate
fees (see below), and ESC or Stormwater Pollution Prevention
Plan (SWPPP) to the Butler County Building and Zoning Department.
- Within five
business days the Butler County Storm Water District will review
the submitted items for completeness. If plan revisions are required,
they will either be made by the Butler County Storm Water District
and distributed to all applicable parties or they will be addressed
at a pre-construction meeting. In some cases a letter will be
sent requiring the applicant(s) to make the necessary revisions.
- If all items
are approved and a pre-construction meeting is either completed
or deemed unnecessary, the Butler Lot ESC Permit will be issued
to all parties listed on the application.
- Routine
inspections will be performed by the Butler County Storm Water
District throughout project life to ensure compliance with the
'Soil Erosion and Sediment Control' standards.
- After each
inspection a status report will be prepared and distributed to
the appropriate parties.
- If it is
